These Terms of Service ("Terms") govern your use of the NomNomBear mobile application ("the App"), operated by NY STUDIO ("we," "us," or "our"), a sole proprietorship registered in Kazakhstan.
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
NomNomBear is a recipe generation app that uses artificial intelligence to create recipes from photos of dishes or ingredients. The App also provides a community feed where users can share and browse recipes.
To use certain features of the App, you must create an account. You can sign in using your Google or Apple account. You are responsible for maintaining the security of your account and for all activity that occurs under your account.
When you first open the App, an anonymous account is created automatically. You can later link this account to your Google or Apple sign-in to secure your data and subscription.
You may browse the community feed without a subscription. All other features require an active subscription.
The App offers the following auto-renewing subscription plans: Annual Plan at $29.99 per year, and Monthly Plan at $6.99 per month. Prices may vary by region and are displayed in your local currency at the time of purchase.
New subscribers may be eligible for a free trial period of 3 days. During the free trial, you have full access to all subscription features. If you do not cancel before the free trial ends, your subscription will automatically convert to a paid subscription and you will be charged the subscription price for the plan you selected.
Your subscription will automatically renew at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the end of the current period. Your Apple ID or Google Play account will be charged for renewal within 24 hours before the end of the current period at the same price you originally selected.
You can manage or cancel your subscription at any time through your device's subscription settings. On Apple (iOS): Settings → Your Name → Subscriptions → NomNomBear. On Android: Google Play Store → Menu → Subscriptions → NomNomBear.
Canceling your subscription stops future charges but does not provide a refund for the current billing period. You will continue to have access to subscription features until the end of your current billing period.
Refund requests are handled by Apple or Google according to their respective refund policies. We do not process refunds directly.
Recipes, nutritional information, cooking instructions, and other content generated by the App are produced by artificial intelligence and are provided for informational and entertainment purposes only. AI-generated content may contain errors, inaccuracies, or omissions.
The App is not a substitute for professional nutritional, dietary, medical, or culinary advice. You should not rely on AI-generated nutritional information for medical decisions, dietary planning, or allergy management.
AI-generated recipes may not identify all allergens or potential allergens present in a dish or its ingredients. If you have food allergies, intolerances, or sensitivities, you are solely responsible for verifying all ingredients and their suitability before preparing or consuming any recipe.
You use AI-generated recipes at your own risk. We are not liable for any adverse effects, health issues, or damages resulting from preparing or consuming food based on recipes generated by the App.
When you save or publish recipes, you retain ownership of the photos you took. By publishing a recipe to the community feed, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and make available your published content (including your display name, profile photo, recipe, and associated photo) to other users of the App. This license exists for as long as your content is published and terminates when you unpublish or delete the content, except that copies saved by other users before removal will remain in their accounts.
When you publish a recipe to the community feed, your display name and profile photo (as provided by your Google or Apple account) become visible to all users of the App. You should only publish content if you are comfortable with this information being publicly displayed.
You agree not to upload, share, or publish content that is illegal, harmful, threatening, abusive, or harassing; contains nudity, sexually explicit material, or otherwise inappropriate imagery; infringes on the intellectual property rights of any third party; contains malware, spam, or deceptive content; or depicts anything other than food, ingredients, or cooking-related imagery when using the recipe generation feature.
We reserve the right to remove any content that violates these standards without notice. The App includes automated content moderation to detect inappropriate imagery.
You agree to use the App only for its intended purpose — generating, saving, and sharing food recipes. You agree not to attempt to reverse-engineer, decompile, or disassemble the App; use the App to generate content unrelated to food or cooking; circumvent or attempt to circumvent subscription requirements or content moderation; use automated systems (bots, scrapers) to access the App; interfere with or disrupt the App's servers or infrastructure; or impersonate any person or entity.
You can delete your account at any time through the Profile tab in the App. Deleting your account permanently removes all your data, including saved recipes and published content. This action cannot be undone. Deleting your account does not automatically cancel your subscription — you must cancel your subscription separately through your device's subscription settings before deleting your account to avoid further charges.
We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine is harmful to other users or the App. We will make reasonable efforts to notify you before termination, except in cases of severe or repeated violations.
The App, including its design, code, branding, mascot (NomNomBear), animations, and all associated intellectual property, is owned by NY STUDIO. You may not copy, modify, distribute, or create derivative works based on the App or its branding without our written permission.
AI-generated recipes are provided for your personal use. You may share, print, and distribute recipes generated for you through the App for personal, non-commercial purposes.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy, completeness, or reliability of any AI-generated content, including recipes, nutritional information, and cooking instructions.
To the maximum extent permitted by applicable law, NY STUDIO and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, data, health, or other intangible losses, resulting from your use of or inability to use the App; any AI-generated content, including recipes, nutritional information, and cooking instructions; unauthorized access to or alteration of your data; any food prepared based on recipes generated by the App; or any other matter relating to the App. Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for the App's subscription in the twelve months preceding the claim.
You agree to indemnify and hold harmless NY STUDIO from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of any third party.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kazakhstan, without regard to its conflict-of-law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Kazakhstan.
We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms in the App or on our website. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
